Trump Appeals to Supreme Court in Battle to Remove Biden-Era Consumer Safety Officials

On Wednesday, President Donald Trump’s Justice Department filed an emergency appeal with the Supreme Court, aiming to overturn lower court decisions that prevented his administration from firing three regulators appointed by President Joe Biden. The regulators in question are members of the U.S. Consumer Product Safety Commission (CPSC), an independent regulatory board responsible for establishing safety standards for consumer products. This appeal follows a previous Supreme Court ruling from May that allowed for the firing of two Biden-appointed officials from other agencies, namely the National Labor Relations Board (NLRB) and the Merit Systems Protection Board (MSPB).

White House spokesperson Harrison Fields emphasized the administration’s frustration with what he described as “rogue leftist judges” who are obstructing the implementation of the Supreme Court’s rulings. He argued that the lower courts’ defiance undermines the president’s constitutional authority to manage the executive branch. The appeal, according to Fields, illustrates Trump’s commitment to executing the agenda espoused by the American electorate. The three appointed officials—Mary Boyle, Alexander Hoehn-Saric, and Richard Trumka Jr.—were installed by Biden with their positions designed to be insulated from political influence, as they can only be removed under specific circumstances such as gross misconduct.

Upon their attempted dismissals, the three officials initiated legal action claiming Trump sought to remove them without justifiable cause. A Maryland federal judge sided with the regulators, leading to an appeals court upholding this decision. This legal battle is emblematic of a larger struggle for control over the agencies that shape regulatory frameworks, highlighting tensions between the administrations and their respective judicial interpretations. Trump’s emergency appeal asserts that the regulators displayed open hostility to his policies, creating internal discord within the Commission.
