Amid escalating unrest in Los Angeles and other U.S. cities concerning Immigration and Customs Enforcement (ICE) policies, a retired FBI agent, Jason Pack, has indicated that serious legal repercussions could arise for those instigating violence during protests. According to Pack, federal authorities may categorize acts of violence intended to intimidate the public or influence political decisions as “domestic terrorism.” Despite the absence of a specific legal definition for domestic terrorism in the U.S., existing laws allow for charges related to violent acts during protests, such as arson or assault on federal officers. The Department of Justice (DOJ) has affirmed its commitment to pursuing the most serious charges available, emphasizing that those engaged in peaceful protests will not be criminalized.

Prominent legal voices, including John Yoo, a former deputy assistant attorney general, support this interpretation by indicating sufficient grounds for charges related to obstructing federal officers.

Pack pointed out a troubling trend wherein organized groups of anarchists instigate violence at protests. These groups, reportedly about 60 individuals, employ strategic planning and secure communication channels to prepare for their actions. Unlike casual protestors, these organized extremists know how to blend into crowds and manipulate public sentiment, often targeting key locations to incite further chaos. Pack emphasized that their tactics, which he notes have evolved since the 2020 riots, aim to provoke confrontations with law enforcement, generating viral content that fuels further unrest while allowing the agitators to escape responsibility for the ensuing damage.
