Halle Berry won a custody battle against ex-husband Olivier Martinez after a judge ruled in her favor due to Martinez’s failure to communicate his lack of availability for coparenting therapy. The court documents revealed that Martinez did not continue therapy during the summer despite having the ability to participate in online sessions through Zoom. This decision by Martinez led to legal fees for Berry that could have been avoided if he had acted in a timely manner. A custody hearing is scheduled for December 12, with Berry seeking sole custody of their son Maceo.
In addition to seeking sole custody, Berry was ordered to pay Martinez monthly child support and a percentage of any income over $2 million. She is also responsible for covering their son’s school tuition, extracurricular activities, and health insurance. Following this agreement, Berry claimed that Martinez was not attending coparenting therapy sessions as agreed upon. Martinez, on the other hand, denied these claims and filed his own request for sole legal custody. He also stated that Berry was unwilling to contribute to his court fees, which could potentially affect his ability to address her claims.
Martinez, in a new court declaration, expressed his desire to resolve any animosity between him and Berry for their son’s benefit. He acknowledged the challenges of coparenting due to his limited work as an actor outside of the United States but hoped to work together on a path forward. Martinez also mentioned concerns about Maceo’s reaction to Berry’s boyfriend, Van Hunt, and his involvement in their lives. Despite these issues, Martinez stated that he never had a problem with Van Hunt and supported Maceo’s relationship with him.
Martinez shared his hope for a return to the improved relationship he had with Berry in the past and emphasized his willingness to comply with all court orders. He mentioned that in 2023, when Berry suggested finalizing their custody arrangement, he requested resolving all other outstanding issues, including child support. Berry has not publicly responded to Martinez’s claims, leaving the ongoing custody battle between the two unresolved. The court’s ruling in favor of Berry highlights the importance of effective coparenting in ensuring the well-being of their child, Maceo. Despite the challenges they face, both parties seem committed to finding a solution for the benefit of their son.
