The investigation into the disappearance of Suzanne Morphew has taken a significant turn after the dismissal of murder charges against her husband, Barry Morphew, in 2022. Following months of stagnation, new evidence emerged linking Barry to her death through the discovery of a rare deer tranquilizer in Suzanne’s remains. Barry was arrested in June 2023 in Phoenix, Arizona, after a grand jury indictment charged him with first-degree murder, alleging that he caused the disappearance of Suzanne, who went missing on Mother’s Day 2020. His extradition to Colorado was quick, leading to his detention in Alamosa County Jail.

The case pivoted dramatically when investigators found Suzanne’s body in September 2023, revealing that many of her bones had been “significantly bleached.” Notably, a forensic examination uncovered the presence of a compound known as “BAM,” a combination of butorphanol, azaperone, and medetomidine. This tranquilizer is typically used in veterinary settings, primarily by professionals for deer transport, raising serious questions about its presence in a human body. Prosecutors pointed out that Barry was the only person in the area with a legal prescription for this drug, placing him at the center of the investigation.

Barry Morphew’s attorney quickly asserted his client’s innocence, criticizing the government’s approach as predetermined and biased. Despite the charges, Morphew’s defense team believes that the evidence collected does not solidify a strong case against him. In contrast, legal analysts, such as Colin McCallin—a former deputy district attorney—have commented on the substantial nature of the evidence linking Morphew to the tranquilizer. The rarity of “BAM” further complicates the narrative for the defense, as the tranquilizer is closely regulated and typically available only to veterinary professionals.

The lingering questions around the timing of Barry Morphew’s re-indictment after the discovery of Suzanne’s body raise concerns for legal experts. Eric Faddis, a former prosecutor, noted that while the tranquilizer evidence is problematic for Morphew’s defense, the prosecution’s past misconduct casts a shadow over the case, limiting their ability to utilize expert testimony effectively.

Despite the legal hurdles ahead, experts assert that the lack of a statute of limitations on murder means that Barry Morphew could still be charged again in the future, providing the prosecution time to strengthen their case. The cautious approach taken by the 12th Judicial District Attorney, Anne Kelly, further emphasizes the careful strategy to avoid pitfalls experienced in the earlier trial. Legal professionals maintain that more work is necessary before any definitive conclusions can be drawn about the case’s trajectory.
