Two Undocumented Immigrants Charged in Shooting of Off-Duty CBP Officer in NYC

Two illegal immigrants, Miguel Francisco Mora Nunez and Cristian Aybar Berroa, were charged in connection with the shooting of an off-duty U.S. Customs and Border Patrol officer in New York City. The incident occurred in Fort Washington Park, where Mora Nunez allegedly shot the officer, hitting him in the face and right arm. In response, the officer returned fire, injuring Mora Nunez. Both suspects, hailing from the Dominican Republic, were arrested shortly after the shooting, with Mora Nunez facing serious charges including possession of ammunition by an illegal alien, which could lead to a maximum sentence of 15 years. Aybar Berroa, charged as an accessory, faces a potential maximum sentence of seven and a half years.

The shooting incident unfolded when Mora Nunez fired upon the officer, leading to a struggle in which the officer was injured. Following the shooting, Aybar Berroa drove Mora Nunez from the scene on a motorbike, allegedly assisting in further criminal activity by attempting to dispose of the bloody clothes worn during the incident. Both suspects are undocumented immigrants with prior legal issues, raising serious concerns among law enforcement about how such individuals were able to remain in the country despite numerous encounters with immigration authorities.

Further complicating the situation is the fact that both Mora Nunez and Aybar Berroa have reportedly been implicated in a February armed robbery in Leominster, Massachusetts. Their criminal histories reveal a pattern of reckless behavior and legal infractions, suggesting that these individuals pose a continued risk to public safety. Aybar Berroa alone has been arrested multiple times, with charges ranging from second-degree reckless endangerment to grand larceny. Unfortunately, even with active detainers from U.S. Immigration and Customs Enforcement, local jurisdictions have released him back into the community.

Aybar Berroa’s criminal past presents a disturbing picture. In recent months, he was involved in various offenses that reflect a disregard for the law, including multiple arrests in 2024. Despite a judge ordering his removal from the U.S. in early 2023, he was still able to navigate the system without being apprehended.
