The Supreme Court is set to issue a decision regarding former President Donald Trump’s immunity from prosecution for his alleged role in the January 6, 2021, riot at the U.S. Capitol. Trump has argued that former presidents should be immune from prosecution for official acts they took in office, in an effort to have the indictment he faces on charges of election interference dismissed. The court, which has a 6-3 conservative majority, is expected to issue a ruling on the matter on July 1. Trump has been indicted on four felony counts related to efforts to overturn his 2020 election loss to Joe Biden, including conspiracy to defraud the United States and conspiracy to obstruct an official proceeding. In May, Trump became the first former U.S. president to be convicted of a crime after being found guilty on 34 counts of falsifying business records in a New York trial related to hush-money payments made to adult film actor Stormy Daniels. Trump has denounced the trial as “rigged” and has stated that he plans to appeal the verdict. He is set to be sentenced on July 11. In a separate federal case brought by special counsel Jack Smith, Trump is facing charges of illegally hoarding classified documents at his Mar-a-Lago estate in Florida and obstructing the government’s efforts to retrieve them. Additionally, he is charged with attempting to overturn his narrow loss to Biden in the 2020 election in Georgia. Trump has denied any wrongdoing in all of the cases.

The Supreme Court has been skeptical in considering arguments about Trump’s immunity claims, but by delaying the decision until July, they have reduced the likelihood of Trump having to stand trial before the November election. Trump has emphasized the importance of strong presidential immunity, stating that it is necessary for the country to thrive and for opponents to not be able to hold future presidents for political gain.
