Former NRL Player Allegedly Lured Woman to Pub Bathroom, Jury Hears

In a recent court case, a woman recounted how she was invited by a man named Robati to an upstairs event at a pub, believing it was exclusive and might even feature complimentary drinks. Once she followed him upstairs, however, she was led into a disabled bathroom, which she felt was a strange turn of events. Initially expecting that Robati was merely offering her narcotics, the situation escalated quickly. Once inside, Robati closed the door, wrapped his arm around her neck, and began to kiss her aggressively.

The testimony revealed that Robati allegedly attempted to force the woman into sexual acts against her will. She expressed her refusal, stating, “I don’t want to have sex with you.” Despite her verbal protest, the jury heard that Robati proceeded to apply both verbal and physical pressure, coercing her into two separate sexual acts within a short timeframe. The woman reportedly felt trapped, unable to escape, and was visibly distressed afterwards, as confirmed by her friends who witnessed her emotional state following the incident.

In his defense, barrister David Funch did not dispute that Robati was present at the pub during the events in question. However, he framed the crucial legal argument around the notion of “mistake of fact.” This concept posits that if Robati genuinely believed the woman was consenting, and if such a belief could be perceived as reasonable in the given circumstances, it could serve as a defense against the charges he faced.

The prosecution’s burden was clear: they would need to demonstrate beyond a reasonable doubt that Robati’s defense of mistaken consent was unjustifiable. This aspect of the trial is pivotal, as it focuses not only on the specifics of what occurred in the bathroom but also on the psychological state and perceptions of both parties involved. The jury’s task is to weigh this evidence critically.

As the trial progressed, the jury was presented with recorded video evidence from the alleged victim, captured in 2024, to further clarify her account of the events. Judge William Everson is overseeing this trial, which is expected to span three days. The proceedings underscore the serious implications of the allegations and the legal nuances surrounding consent and coercion in sexual offenses.
